A Private Membership/Ministerial Association (PMA) is rightfully created on the protected “unlimited right to contract” as stipulated in Article I, Section 10, Clause 1 of the US Constitution.

A PMA is created under common law by PRIVATE people in the interests of PRIVATE members and does not require any outside authority or permission, of any kind whatsoever, from any State government or agency for its creation in order for it to exist or function.

Public Law, Regulations, and Public Rules which are created by State run administrative agencies that regulate the “PUBLIC” do not generally apply to a PRIVATE MEMBER/MINISTERIAL ASSOCIATION’s (PMA’s). The rules of governance of a PMA, and its function, and how members derive benefits of membership are dictated exclusively by the membership bylaws as well as case law involving contracts.

In the U.S., there is a separation of Private and Public (an example would be the limits of government intrusion into church legal matters per the separation of “church and state”).

Public: The “Public” domain is a legal group of people (“the Public”) who are governed and protected by a government entity and regulated by statutes and administrative rules.

Private: The “Private” domain is where individuals choose to contract and govern themselves according to the bylaws of the Private Membership Association (PMA). A familiar example of a Private Membership Association would be a boxing or MMA organization, where participants could possibly be charged with murder or assault and battery if they were acting in the public domain rather than a contractually binding PMA. Participants of such PMA’s contractually agree to terms and conditions stating that they are acting in a Private capacity which removes liability and risk of legal charges amongst participating members which could and likely would arise if the physical violence occurred while they were in their “Public” capacity.

What Is the History…

Of a Private Membership Association?

The US Supreme Court has defined the right to associate, as private members, as inseparable from the right to free speech. As a result, the right of association under the US Constitution was heavily litigated in the 1950s and 1960s, and the Court consistently upheld members’ rights. In fact, the right of association became a cornerstone of the civil rights movement.

Private Membership/Ministerial Association members, parties, and beneficiaries are extended absolute immunity from all criminal, civil, administrative, and other actions, procedures, and processes, and other laws, codes, rules and/or regulations. The exception to this general rule is when the activities of the private membership association present “a clear and present danger of substantive evil”.

Members of the Nutrition by Design private membership association (PMA) may find that they have more opportunity to accomplish their personal God given health and wellness goals than they would if they relied exclusively on what is available to them from the Public domain.

Nutrition by Design is a lawful Private Ministerial/Membership Association, protected by the United States Constitution Article’s 1, 4, 5, 9, 10 & 14 and long-settled rulings by the United States Supreme Court.
